Rospotrebnadzor demanded on Thursday from tour operators and travel agents to return money to Russian tourists who refuse to travel to Egypt due to the escalation of the internal political crisis in this country.
Referring to yesterday’s statement by the Russian Foreign Ministry, which speaks of a dangerous escalation of the internal political crisis that gripped the country and the imposition of a state of emergency, Rospotrebnadzor in an official statement said the following: , in relation to which the parties to the agreement on the sale of a tourist product should be guided by the provisions of Article 14 of the Federal Law of November 24, 1996 No. 132-FZ «On the Basics of Tourism Activities in the Russian Federation», in accordance with which upon termination of the agreement on the sale of a tourist product the tourist and (or) other customer is refunded a sum equal to the total price of the tourist product, and after the start of the trip — a part of it in an amount proportional to the cost of services not provided to the tourist. »
Separately, the supervisory authority emphasized that the obligation to return the corresponding funds in the event a tourist exercises his legal right to unilaterally terminate the contract lies solely with the tour operator (travel agent) as a party to the contract for the sale of the tourist product. “If the tour operator (travel agent) evades the fulfillment of this statutory obligation voluntarily, the protection of the corresponding violated right of the tourist will be ensured in court. Moreover, in this case, the degree of responsibility of the obliged party will increase due to the possible application of appropriate civil law measures to it, ”Rospotrebnadzor said in a statement.
The department also reminded tourists that Federal Law No. 132-FZ of November 24, 1996 «On the Basics of Tourist Activities in the Russian Federation» provides for the right of tourists to receive emergency assistance and evacuation carried out by an association of tour operators in the field of outbound tourism in accordance with the said Law. «In cases of impossibility of fulfillment, non-fulfillment or improper fulfillment by the tour operator of obligations under the agreement on the sale of a tourist product, the tourist has the right to apply for emergency assistance to the association of tour operators in the field of outbound tourism» Tourpomosch «, — the official statement says.
Recall that the Russian Foreign Ministry recommends that Russian citizens in Egypt avoid areas of mass protests, and those who arrived in this country for tourist purposes should take into account the current situation, refrain from traveling outside resort areas, excluding visiting Cairo and other large cities.
